ABS Kids has an exciting remote Corporate Counsel opportunity. The Corporate Counsel is responsible for ensuring compliance with state and federal regulations, particularly those related to Applied Behavior Analysis (ABA) services, with an additional focus on reviewing leases and Letters of Intent (LOIs). The role includes analyzing and interpreting payor manuals, payor fee schedules, state regulations, and real estate agreements. The Corporate Counsel will provide legal guidance on regulatory matters, maintain documentation, and collaborate with various teams to ensure adherence to legal and regulatory standards.

What will you do?

Review, draft, and negotiate leases and Letters of Intent (LOIs) for company properties
Ensure that lease terms and conditions align with the organization's strategic and operational objectives
Advise on legal risks and implications associated with lease agreements and real estate transactions
Provide support and guidance to internal teams on lease agreements, regulatory compliance, and legal matters
Analyze and interpret payor manuals, payor fee schedules, and state regulations related to ABA services
Identify and communicate any changes in regulations and their potential impact on the organization
Ensure that company policies and procedures comply with relevant state and federal regulations
Conduct regular reviews and audits to ensure ongoing compliance
Maintain detailed and organized records of regulatory requirements and changes
Provide clear and concise summaries and reports to relevant stakeholders
Work closely with clinical, billing, and administrative teams to ensure understanding and implementation of regulatory requirements
Provide support and guidance to internal teams on regulatory compliance matters
Serve as a subject matter expert on lease agreements, regulatory matters, and real estate legal issues
Develop and deliver training programs for staff on regulatory compliance and updates
Continuously monitor changes in regulations and payor policies and proactively address potential impacts on the organization
Prepare and present reports on lease and LOI status, regulatory compliance, and legal issues to senior management

Who are we looking for?

Juris Doctor (JD) degree from an accredited law school
Admission to the state bar
3-5 years of experience in legal and regulatory analysis, with a focus on either ABA services or real estate legal matters referred
Actively holds healthcare compliance certification (CHC, CHPC or similar) or is willing to obtain certification within the first two years of employment
Demonstrated understanding of HIPAA, Privacy Act, FWA, Stark and Anti-kickback laws, and Medicare/Medicaid regulations
Proficiency in using legal research tools and software, and comfortable with data management and reporting systems
Able to read, analyze, and comprehend complicated contract requirements, regulations, and statutes
Excellent knowledge of legal, ethical, and compliance procedures, regulations, and requirements
Able to juggle competing demands and priorities while meeting strict deadlines and maintaining strong attention to detail
Strong analytical, project management, and problem-solving skills
Comfortable leading in an environment of constant change and ambiguity
Demonstrated working experience and expertise in negotiating privacy and data protection agreements, including business associate agreements and data use agreements
