Summary: This position provides comprehensive legal services to the Charlotte-Mecklenburg Board of Education ("Board") and all levels of District personnel, departments, and divisions.
Essential Duties: (These duties are a representative sample of the major duties and responsibilities and may vary by position.)
- Advises the superintendent, instructional staff, and operational staff regarding student issues that include special education matters involving the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act, student discipline, academics, custody and parental access disputes, FERPA and other confidentiality issues; employment matters that include employee evaluation, discipline, employee grievances, licensure, and matters arising under Title VII, Title IX, the ADA, the ADEA, the FMLA, the FLSA, and other state and federal laws impacting public school employees; and transactional matters that include contracts, procurement, real estate, district operations, and intellectual property
- Represents the Board in lawsuits in federal and state courts
- Represents the Board at court hearings and administrative proceedings
- Represents the superintendent in student discipline hearings, employee grievances and appeals to the Board
- Conducts legal research and renders legal opinions
- Recommends changes to Board policies and regulations to ensure compliance with applicable state and federal laws and the North Carolina Department of Education policies and regulations
- Coordinates and provides in-service training/professional development on legal matters
- Works cooperatively with in-house and outside counsel
- Performs other services and tasks as directed by the General Counsel and the Deputy General Counsel
Education and Experience:
Minimum:
- Juris Doctorate degree from an accredited law school
- North Carolina Bar License or eligible to be licensed in NC within 1 year of employment
Preferred:
- Experience working in a school district or governmental entity
- Litigation or administrative hearing experience
- Contract review and negotiation experience
Licensing / Certification Requirements:
North Carolina Bar License or eligible to be licensed within 1 year of employment
Knowledge / Skills / Abilities:
- Knowledge of state and federal law, Board policies and regulations, and North Carolina State Board policies and regulations
- Ability to analyze legal issues, research applicable cases and laws, and develop effective legal strategies
- Ability to issue spot and exercise sound independent legal judgment, work as part of a team, and get up to speed quickly on any necessary or lacking knowledge base
- Ability to prioritize, manage simultaneous tasks, and meet strict deadlines within a rapid-paced environment
- Ability to work under stress and prioritize tasks with competing deadlines
- Ability to communicate effectively both verbally and in writing
- Ability to present information in a comprehensive manner for a wide variety of audiences
- Ability to establish and maintain effective working relationships with the Board, the superintendent, school-based and operational staff, and community and governmental leaders
- Strong interpersonal and advocacy skills for conducting in-district and statewide trainings for school leaders, advising the Board, and handling oral arguments and motions in court
